Minutes of the Meeting held on 9 11 10

Agenda 1: ATR on the MoM dated 02.11.2010
Noted.

Agenda 2: Note explaining delays for preparing Annual Reports for the year
2007-08, 2008-09 & 2009-10.
Commission noted that there has been substantial delay in the
preparation of the Annual Reports for the years 2007-08, 2008-09 &
2009-10. It was pointed out by the Secretary of the Commission that
the Reports were held up as several public authorities did not furnish
the required information for completing the Reports. Commission
observed that, in the past too, not all public authorities had furnished
the information as per Section 25(2), the Reports were, nevertheless,
submitted to the Parliament with a note that "not all public
authorities have furnished information". There is no reason why that
practice should not be followed now. In any case, the delays of this
magnitude are not expected. The Secretariat should have brought up
this matter before the Commission earlier.

Commission directed that expeditious action should be taken to
complete the Reports for the years 2007-08 and 2008-09 and send
these to the Department of Personnel & Training, immediately, for
causing it to be laid before the Parliament at the earliest.
Secretariat will keep the Commission apprised of the progress in
completion of the Reports at the weekly meetings.

Agenda 3: Highlights of draft rules of the Government on RTI
Commission authorized the Chief IC to send its comments to the
Government on draft rules on RTI.

Agenda 4: Report of IC (LS) and IC (SG) on the workflow system of the daks
in the Commission.
Commission could not discuss the matter.

Agenda 5: Order u/s 19(8) (a) to be issued to PA's –for approval please.
Commission discussed the draft order. It was agreed that the order will
be issued under the signature of all ICs. Commission decided to create a
portal wherein all the public authorities will upload their information in
a prescribed format regarding record management obligations and
personnel details and functions as mandated u/s 4(1) (a) and 4 (1) (b) of
the RTI Act within a timeframe as directed in the above mentioned order
of the commission.

Agenda 6: Direction of the Commission regarding freezing of data for annual
return during 2009 -2010.
Commission was apprised of the status of the submission of Annual
Returns submitted by public authorities during 2009-10. Out of 1848
public authorities registered in the database 1421 have submitted their
returns as on 31 10 2010 even after reminders. Commission directed to
freeze the data and report on the basis of available data. It also directed
to write a separate chapter on the abject failure and callousness of the
public authorities in submitting their reports to the commission in
contravention of stipulations regarding their obligations u/s 25 of the RTI
Act, along with their names. Commission further directed to make all
necessary arrangements to ensure that the report for 2009-10 is sent to
the government for causing to be laid before the parliament at the
earliest.
