Thank Mr. Bhanot for your hard work. This week, RTI will befiled. 
In the meantime, I inform that After the tough talks by the loan applicant and my friend, Bank of India has sanctioned Rs 31,000 as fee for the second semester.  Bank said that it will not grant any loan towards other expenses such as hostel fee, uniform, amount for the purchase of books etc.

 

He told that under the RBI guidelines for Education loan up to 4 lakh, no guarantor is required but the Bank has released even Rs. 31,000 after taking two guarantee. He has come to know from reliable sources that the on-going rate for the sanction of loan is 10%.

The solution below may or may not bring you the immediate solution. But it is sure the the Bank Management has to explain every bit of action they taken/not taken.

Please ask your friend to file RTI Application with the PIO of the concerned Public Authority i.e. Bank of India Branch (where loan has been applied for) via Speed Post. While filing RTI Application detailing the problem being faced by your friend and quoted therein your all previous references of date-wise letter/telephone/personal visits/verbal discussions to the office of the Public Authority  and ask for the following information (Please use all or some points as suited to you. Point No. 6-9 below is essential for quick and positive action):

 

01.       Inform me the day to day action taken on my various requests made earlier (give date wise detail of your letters/visits/phone calls).

02.       Inform me the time needed as per law to finalize the required action.

03.       Inform me latest status of your request.

04.       A. Provide me the certified copies of the

a.         File Notings relating to this matter from DD/MM/YYYY to DD/MM/YYYY.

b.         Day-to-day moment of File relating to this matter from DD/MM/YYYY to DD/MM/YYYY. (Now, in a decision involving the EPFO, IC SG has clearly ruled that the day to day movement of the file has to be given in the format asked for. ttp://www.rti.india.gov.in/cic_deci...14_M_37059.pdf)

05.       Inform me reasons for the delay

06.       Inform me Name & Designation of the officers/Officials responsible for taking action on your request.

07.       Inform me Name & Designation of the officers/Officials responsible for causing delay on your request.

08.       This application may also be treated as a Notice u/s 80 CPC and the action taken thereunder may also be inform to me in due course.

09.       I have paid fee for the purpose. I am a consumer. The delay is a deficient service. Moreover I am being harassed. What compensation is proposed to paid to me. if Nothing, This may please be treated as a Notice under the Consumer Protection Act, 1986.

10.       Inform me the manner in which the PA is proposing to compensate you for the mental agony and deficient service.

11.       Any other point on your mind (Think Hard).

My friend has applied for an education loan of Rs. 4.00 Lakh from Bank of India about one month ago.   His son is doing B.Sc. in Hospitality and Catering Technology from the Institute of Hotel Management (Recognized) Lucknow which is under Ministry of Tourism.  Till date the bank has not sanctioned the loan and asking one paper after the other.  He told me that there is no rigid formality for the loan up to 4.00 Lakh and it appears that the loan sanctioning staff is expecting something before they sanction the loan.  The responsibility of repayment of loan will rest on his son after he complete the course.  He also told that other students have already taken the loan up to that amount from other banks without much hassle and paper work. 

 

The last date of payment to Instituted is 24th and in this short duration, What is the best option available to the applicant? The issue may not directly be linked with RTI discussion but the suggestions by the members will definitely help him and others. This is the question of one's career.
