RE: [rti4empowerment] Role of RCS in Cooperative Group Housing Societies

Thanks for your response which I have been waiting from an intelligent expert so long.
 
2.  Secondly, RCS is a public authority from which I can ask some question, particularly this one. RCS says that Coop. Group Housing Society
     is not a public authorty. I myself know this. Had it been so, I would have sought information from the Society. 
 
3. I am one of the 80 members and hold share certificate also since 1988.
 
4. As per my information,  no CGHS can draw lots without the presence of one representative from RCS ( a supervisory and monitoring authority
   under DCS Act) office and one from DDA which hss given land to the Society on subsidised rates). These two pwersons from thesae agencies
   come for draw of lots when membership is beyong doubt. These days in Dwarka, representatives of RCS and DDA are not coming for draw of lots
   for those societies which were investigated by the CBI. Out of 57 or 47 socieities, 27 have held draw on their own by calling politicians. RCS has
   threatened for legal action against these societies. 
 
5. You know that for some time, Mr. Satyya Gopal comparatively an honest I.A.S officer who issued show cause notices to five members who own
    immovable property in posh colonies in Delhi (In Delhi 65 to 70 percent flats are kept by builders for commercial purpose and they are sold within
    2-3 years of allotment).  After asking for the repective files twice by him to the President of the Society, Society did not submit papers to RCS. 
   After his trasfer, new RCS also asked two times, but Society did not oblige him also. After some settlement (how much money was involved in the deal)
   this RCS having found immovable property by these 5 members, he issed non-speaking orders saying " According to the President of the Society, the appellant
   has grudge against the Society and certain members and there is no truth in the complaint, I allow these members to have this flat of the Society also.      .      
 
6. My only question is whether RCS cannot be asked to get information from the Society if it has supervisory and monitoring role under DCS Act?
 
7. Some other friend also has adviseed me to make a criminal case against the Society.

If you have a grievance against the Society / RCS then RTI is not the tool to resolve it.
Have you availed your remedies under the DCS Act and Rules. Actually do you even possess a copy of the DCS Act and Rules, or have read it ? Have you availed your criminal remedies ?

1) Let me say that the RCS has given you a perfect reply. Is it your say that the 79 affidavits are physically held by the RCS "I have asked for information
which is with this Public Authority
" ? If so under which clause / Rule / Bylaw /Practice is it held by the RCS and not by the Society?

2) How many flats are there in the Society in question ? If there are only 79, then how come you are the 80th member ? Are you an original founding member ? How were you inducted as a member ? Do you have a valid share-certificate ? Can you vote at the elections ? What were you doing when only 79 flats were constructed ?

3) The 3rd query you have raised is because of the complete corruption by former RCS and Delhi Govt and LG and land mafia. You all know the Diwakar scandal. You are probably the victim of a criminal fraud  / cheating. Your remedy (if any) lies elsewhere

MY question is:
 
1. Is Registrar of Cooperative Societies, Govt. of NCT of De3lhi is not a public Authority? If it is, I have asked for information
which is with this Public Authority?   I have never said that you forward my RTI application to the Society.   
 
2. Is RCS office has no role to play as regards monitoring the activities of the Societies and seek RCS  permission by se3nding relevant documents including 
    members' affidavits for final darw of lots?
 
3.  I was the 80th member who was not allotted the flat. No reason is given by the RCS or the President of the Society
 
4.  If RCS has no role, why 27 Coop. Group housing Socieites of Dwarka which held  the draw themselves as RCS is not ready to send its representative 
    for the draw, should be given any notice for legal action against them? RCS is not ready to send its nominee for the draw despite Delhi High Court
    Orders and instructions of the Cheif Minister of Delhi.
 
On hearing from RTI activists, I shall give immense material of corrupt practices to the Movement of RTI as well as Fight against Corruption or
India Against Corruption the subject of todays' RALLIES all over India.
