But for information to all/you  the  MPs have made   themselves ENTITLED to pension by being  ONE DAY in parliament, thats  after he/she takes oath, because they have omitted the minimum service period from the rule for pension for MPs. any person who was MP for  ANY period shall be paid pension, including those members of constituent assembly. Is it not great job done by the MPs of all parties ?. The MPs should serve a minimum of ten years, similar to a public servant,  to become entitled for pension and perks.  they have also made SC judge entitled to pension after ONE DAY in the court wef Apr 2004. this was done so that no body challange the MPs getting pension after one day in parliament. you may call such act what ever you like, all MPs are together in it.   rgds. beniwal

We the citizens of Real India take certain steps immediately:
 
1. We must stop addressing the Ministers in Centre and in States, addressing them 'Hon'ble'
 
2.  No body including ministers and their relatives not living with them also should get free security staff when they are paid from the common man's contribution to Central and State Taxes.
 
3.   No free passes for air travels and by railways for the family members of the buraucrats.
 
4.   No pension for any MP or MLA if he/she has not served for 20 years at least. No question of pension after 5 yeras of getting MP ship or MLA ship. There should be record of time and days when the elected so-called representative in Partliament and State Assembly.
 
5.  Travelling by vehicles for the members of Babus for getting vegetables from the market, going to schools and colleges by sons/daughters of Babus must be stopped. Let them hire taxis by paying from Babu's salary.

Your approach appears to be very logical as you have first described the rationale and then proposed sending of mails.

The whole of nation fought for Jan Lokpal, politicians made it to be a shameful and disgraceful tamasha as govt appointed Abhishek Manu Singhvi as the chairman of the standing committee deciding Lokpal draft, babus were cunning and our TV channels so eager to sell the ad time made the whole serious issue of corruption  as a joke. People got disillusioned. India does not know how to make netas work, babus accountable, police act as Law Enforcement Agencies for all on equality basis and judiciary come out of their self planned sleepy mode and many times deciding the verdict first and trial later.

Your approach of sending carefully drafted mails with startling facts  to serving babus from distinguished citizens who have served the nation with distinction and are recognized as respectful people and most of the babus receiving the mails from such a well respected fraternity would get impacted for improvement. I say this because your mails will contain such unquestionable startling facts, if babus act the aim is achieved. If babus choose to ignore and the sordid state continues then these babus would be liable to be taken to court for dereliction of duties even when they have been told about the impending disaster through these mails.  
 
Let your initiative awaken the babudom to their responsibility clearly knowing that the sword hangs on their heads if they do not take action.

The "10 million" reference is about another of my social work
associations which is
not connected with RTI, (but with A) nation building as per Indian
tradition B) Elimination of corrupt persons).

As we can all sense, l and I'm sure nobody will deny it, the Indian
people are sheep who can be easily brainwashed, controlled by foreign
parasites, and easily led astray into wasting their time in blind
alleys and useless activities. (ie. "Lotus Eaters"). It is only our
Defence forces which have held the nation together (until now). After
retirement most of glorious IESMs revert to mean and indulge in Lotus
Eating activities.

If even 50 of our IESM members volunteer to send just 2 emails
(drafted by me) to babus (selected by me) ONCE a MONTH,  we will
witness change taking place before our eyes and in our lifetimes.

Screw social media and public battles - those are for Lotus Eating
NGOs.  Patriots execute covert actions against precise targets based
on proper intelligence.

For instance, I want 50 volunteers to send an email (which I have
already sent in my own name) to the Babus concerning how 8,000
Ministry of Defence computers were hacked by the Chinese and the babus
are still fighting over who will investigate the matter. No
investigation has taken place and 1000's of Top Secret files of Army
and Assam Rifles were sucked out of MoD computers and these computers
are still connected to the Internet leaking away to our Enemy No.1.

After this I want to send an email about a recent CONFIDENTAIL Cabinet
Secretariat project which re-employs retired babus at per-diems of Rs.
5,000 per day with stay in 4 star hotels in Delhi and regular to=fro
air tickets etc. The names of the people selected are an eye opener.

Please ignore such parasites of the society .Do not invite them on any function unless he proves himself as a real patron of the society.Looking at the lavish celebrations  made
on marriage, birthday and on many such occasions the country is now a safe haven for a limited few of unearned income[Black -Money] persons.Please shun such gatherings with the contempt it deserves.When you are in distress none of these self seekers have time to be by your side for help.It is time for silent protest by each one against such vulgar life style of few.

Odisha Information Commissioners never ensure information to the Complainant despite knowing that the order of the Commission to provide information complied   neither by the PIO nor the 1st Appellate Authority. Since 2011, it has become useless strategy of Odisha Information Commission to arbitrarily dispose the Complaint   cases without hearing and remanding to 1st Appellate Authority to provide information to the Complainant. In so-called order, the Commission also asks the complainant to file Second Appeal before the Commission, if he or she is not satisfied with the order of the First Appellate Authority.  

 Mr. Tapana Mohapatra, RTI Applicant based in Bhubaneswar had submitted an application to the PIO, Office of Tahasildar, and Bhubaneswar seeking information about land issues in vicinity of Bhubaneswar. It needs to be mentioned here that huge corruption and irregularities in respect of land allotment and purchase and sale of land is going on in Bhubaneswar.  Getting no response from Govt. Mr. Mohapatra filed complaint   before Odisha Information Commission on 6.1.2011. Mr. Pramod Kumar Mohanty, SIC  without  hearing the  Complaint case ( CC No- 02/2011)   arbitrarily  remanded  to the 1st Appellate Authority, office of Tahasildar, Bhubaneswar on 31.10.2011  to dispose the case  within 30 days and asked the  Complainant  to come with 2nd appeal  again to the Commission , if he fails  to get  information.

 Finding no justice from the 1st Appellate Authority as per direction of the Commission, Mr. Mohapatra  again approached the Commission  intimating Mr. Pramod Kumar Mohanty, State Information Commissioner about  non-compliance of  his order by the 1st Appellate Authority on 9.12.0211. Though more  than 6 months have  passed, Mr. Pramod Mohanty   has neither  heard the case  nor ensure d information. Mr. Tapan Mohapatra, complainant  is waiting  for unknown period  to get the information.

 This  is the true  Character of Information Commissioners  in Odisha. They use their power  and authority  to protect  corruption  of Govt.  and corrupt officials  at the cost  of the interest of  Complainant-citizens.

 If  anybody  has any query, Please directly  talk to Complainant on his mobile ( 94376-35267).

The "10 million" reference is about another of my social work

As we can all sense, l and I'm sure nobody will deny it, the Indian
people are sheep who can be easily brainwashed, controlled by foreign
parasites, and easily led astray into wasting their time in blind
alleys and useless activities. (ie. "Lotus Eaters"). It is only our
Defence forces which have held the nation together (until now). After
retirement most of glorious IESMs revert to mean and indulge in Lotus
Eating activities.

If even 50 of our IESM members volunteer to send just 2 emails
(drafted by me) to babus (selected by me) ONCE a MONTH,  we will
witness change taking place before our eyes and in our lifetimes.

Screw social media and public battles - those are for Lotus Eating
NGOs.  Patriots execute covert actions against precise targets based
on proper intelligence.

For instance, I want 50 volunteers to send an email (which I have
already sent in my own name) to the Babus concerning how 8,000
Ministry of Defence computers were hacked by the Chinese and the babus
are still fighting over who will investigate the matter. No
investigation has taken place and 1000's of Top Secret files of Army
and Assam Rifles were sucked out of MoD computers and these computers
are still connected to the Internet leaking away to our Enemy No.1.

After this I want to send an email about a recent CONFIDENTAIL Cabinet
Secretariat project which re-employs retired babus at per-diems of Rs.
5,000 per day with stay in 4 star hotels in Delhi and regular to=fro
air tickets etc. The names of the people selected are an eye opener.

We the citizens of Real India take certain steps immediately:
 
1. We must stop addressing the Ministers in Centre and in States, addressing them 'Hon'ble'
 
2.  No body including ministers and their relatives not living with them also should get free security staff when they are paid from the common man's contribution to Central and State Taxes.
 
3.   No free passes for air travels and by railways for the family members of the buraucrats.
 
4.   No pension for any MP or MLA if he/she has not served for 20 years at least. No question of pension after 5 yeras of getting MP ship or MLA ship. There should be record of time and days when the elected so-called representative in Partliament and State Assembly.
 
5.  Travelling by vehicles for the members of Babus for getting vegetables from the market, going to schools and colleges by sons/daughters of Babus must be stopped. Let them hire taxis by paying from Babu's salary.

Your approach appears to be very logical as you have first described the rationale and then proposed sending of mails.

The whole of nation fought for Jan Lokpal, politicians made it to be a shameful and disgraceful tamasha as govt appointed Abhishek Manu Singhvi as the chairman of the standing committee deciding Lokpal draft, babus were cunning and our TV channels so eager to sell the ad time made the whole serious issue of corruption  as a joke. People got disillusioned. India does not know how to make netas work, babus accountable, police act as Law Enforcement Agencies for all on equality basis and judiciary come out of their self planned sleepy mode and many times deciding the verdict first and trial later.

Your approach of sending carefully drafted mails with startling facts  to serving babus from distinguished citizens who have served the nation with distinction and are recognized as respectful people and most of the babus receiving the mails from such a well respected fraternity would get impacted for improvement. I say this because your mails will contain such unquestionable startling facts, if babus act the aim is achieved. If babus choose to ignore and the sordid state continues then these babus would be liable to be taken to court for dereliction of duties even when they have been told about the impending disaster through these mails.  
 
Let your initiative awaken the babudom to their responsibility clearly knowing that the sword hangs on their heads if they do not take action.

An Open Letter to Elected Representatives &
Political Party Leaders

 

In my personal capacity, I am inviting the awkward distinction of adverting to you regarding the recent defence scams, deficiencies, neglect, delays, procedural tardiness and the like, which are disturbingly dangerous for the defence of the country.

 

The Air Force strength sanctioned for 42 squadrons has come down to 32, and, at this rate of obsolescence and ageing, will dwindle further to 29 as appears in the media. The MiG 21s have started failing and killing pilots. The Air Force and Naval aviation basic trainer HPT 32 have all been grounded; the next in line, Kiran trainers have dwindled to a handful; the next MiG 21s are already too old.

 

The Naval pilots are being sent to USA for their basic flying training (TNIE of 8 May 2012), and the Air Force may have to send theirs perhaps to Sweden! Navy's Sea Harrier aircraft strength too has come down to a handful. Our Submarine fleet is not up to challenging the Chinese counterpart's entry into the Indian Ocean, which is the maritime area so vital to our trade, economy and security.

 

The Army Chief has brought out a list of obsolete, ageing and deficient items in the Army's vital weaponry, ammunition and equipment. What the Army Chief said early this year about the Army, the Air Force and Naval Chiefs had said about their Services two years ago, as reported in the press. Despite the deteriorating and unsatisfactory state of our Armed Forces as reflected by all the Chiefs, every one of them has said that they "will fight with whatever they have". Which, when translated into reality on the battle ground, will mean only one thing: that the soldier (includes naval person and airman) will sacrifice himself and be converted into a martyr by the government, by the political parties and by the people themselves. Does this require any bright brain or complex logic to conclude?

 

I am making bold to ask you elected representatives, party leaders, government officials and intellectual fraternity a few questions in this regard as a common citizen, as an educated and responsible person and as an old soldier of 35 years service in the defence of our country:

  • Why have all of you, each one of you, permitted this downslide?
  • Why have you not raised these issues in the parliament and other relevant for a, or with the elected representatives/ party leaders?
  • What has been your contribution to arrest this downslide?
  • Why are you trying to glorify the soldier and his martyrdom more than ensuring healthy, well equipped, well armed, well oiled and well provided defence forces and defence preparedness?
  • Why is it difficult for you to understand that the cliché of the man behind the gun beng more important than the gun has its limits, beyond which that man behind becomes dead and useless?
  • Why do you act so negligently as to treat the soldier as gun fodder, to be raised to glorified martyrdom deserving tears and garlands?
  • What efforts have you made, or are making, to become aware of defence and military preparedness issues to ensure the country's and its people's security, both external and internal, even as our history shows repeatedly that we received frequent beatings precisely because we neglected these very issues?

I know you will find these questions hard to answer. You may even vent your displeasure over my temerity to confront you on the issues. I am posing them as a common citizen, affected citizen, in our so-called democracy. Yet, I do very sincerely and seriously request you to consider the issues and attend to cleansing the muck we have created.

[HumJanenge] HC stays CIC order for inquiry against sr officers

New Delhi: The Delhi High Court on Monday stayed a Central Information Commission (CIC) order setting up an inquiry against some senior officers of the transparency panel for their alleged failure to reply to an RTI query filed in December 2010.

Asking Information Commissioner Shailesh Gandhi to repond by November 1, Justice Vipin Sanghi stayed his order setting up an inquiry against Anita Gupta, First Appellate Authority, M C Sharma, retired PIO, S Padmanabha, CPIO and Akash Deep Chakravarti, Deemed PIO and JS(Law) on an application filed by Naveen Kumar Peer under the Right To Information (RTI) Act alleging that the officials have failed to give "satisfactory" reply to his plea.

Justice Sanghi passed the order on the plea of Chakravarti, an IAS officer and presently posted as Deemed PIO and JS(Law) with CIC, through counsel Rajiv Bansal challenging Gandhi's April 19 interim order for the inquiry.

Acting on a RTI plea of Peer alleging that the reply sent by the department was without signature, Gandhi had examined the records and ordered for setting up an inquiry against the CIC officials under section 18 of RTI Act and also summoned them to appear before him.

"A reply from the Legal Cell without any any date and signature or name of person providing the informations states that the appellant (Peer) filed many RTI applications after sending letters which were incoherent....

"The total facts revealed before the commission do not appear to be compatible. The commission is therefore setting up an inquiry under section 18 of RTI Act to uncover the true facts," Gandhi said in the interim order.

As per Chakravarti's petition, "The respondent 1(Gandhi) has in a malafide manner, grossly misused its powers vested in him under the RTI Act and has clearly acted in a manner denying natural justice to petitioner (Chakravarti)...."

He contended that the order was passed without even issuing show-cause notice to him.

Chakravarti claimed that Peer had filed more than 5000 applications under RTI before CIC and said in December 2010 he had written a letter to the commission under the title "all held decisions due to civil writ petitioner number 12210/09 and 13550/2009 against CIC and others with High Court, New Delhi" which was "without clearly describing either the subject matter or the issue concerning him."

According to the petitioner, Peer had also sought an appointment with the concerned CIC officer to offer his suggestions and service which was in the form of letter but not an application. However, the reply was sent to him in February but being aggrieved with the reply, Peer had filed a plea before First Appellate Authority.

Again in April, 2011, another reply was sent to him but Peer filed a second appeal before the information commissioner in May last year.

Mr Sarbajit,

You might be right, but do you have the "records" to prove what you are saying ?

I only mentioned "facts" based on records obtained through RTI.

ANT did not want to be relieved from DoPT till he found a pliable
Jt. Secretary who willingly included his name, in the list sent to the selection committee.

I only wonder why Mr Consul did not become IC and why Ms. Alka Sirohi preferred
UPSC over CIC, although she was one of  the 214 applicants.

Maybe, as the old saying goes, we need some exceptions to prove the rule.

ANT may have won the battle for Chief, but MAA ended up getting higher salary and the tag of "guest of state".
Poor ANT was left in the lurch, fighting his case, now in Kerala High Court.

PS: By the way, do you have any idea if CIC is still footing ANT's legal bills ?

Mr.ANT was slated to become the first C'IC. Unfortunately (for RTI
regime) Mr. Habibullah used his networking with No.10 (Janpath .. and
possibly Downing Street through MI6) to be appointed instead. In fact
the RTI ACt in 2005 was such an important legislation (at the time)
that ANT could not be relieved from DoPT till the Act was
operationalised.

Mr ANT fought it out later with MMA (???) on a point of principle. =
He was senior on all counts.

Friends, The conroller and Auditor General; of India has statutory powers in regard to take the Public sector also into tasks and initiate action if gthe Fuinds of the exchequer are utilised not according to Law.     It has been reported some time back most of the political and government persons have utilised the air india & Indian air lines flights and have not paid for their services which is the main cause of the backlog of the problem.    Could some of us complain to the CAG to take up further action against whoever is responsible for the financial status and make personal recovery of the funds than permitting the official doling out from the tax money.  Let them know that personal and political uses are not permitted at the cost of public tax. dwarakanathdm

The case of AIR INDIA is a clear example of WHY the 'politician' & 'babu' would not like it to be disbanded.
 
Except for a very few private airlines, other just do not bother for both these categories. Can you imagine INDIA without this carrier- who will provide free seats to politicians / babus and their families? This is like 'PASSES' in case of RAILWAYS. Everyone and anyone is enjoying the free LOOT.
 
This is the reasons, why NOT a single politician has raised the voice of 'disbanding' the Maharaja.
 
It is high time, some well informed people take up with the SC to direct Govt to wind up the set up.
 
It is same Govt which is dragging feet, going to SCourt against its  orders for paying 'rank pay' arrears to SOLDIERS and ONE RANK ONE PENSION - which as per their own estimates will cost only 1300 crores as against 100,000 crores dumped on theis carrier.

[HumJanenge] RTI-PIO boards on WR-CR Rly stations in Mumbai

Friends
            last year after struggling with Western Railway for almost 13 months I manged to get around 800 PIO boards installed in Western Railway from Churcgate to WR limits.( East and West sides)
Few days back I got confirmation from HQ-CR that they have finished installing with Mumbai Divn and the rest are in process throughout CR limits.

I dont know how this reflects on the self created crisis in our
national carrier.
We have lots of relatives of our political class parked there on a
permanent basis right from sukh ram, lalooji, tiwariji, pawarji and
not to miss rajat sharmaji's own brother.

Respected Sir,
 
1.   CIC Resolution passed in the Commission's meeting held on 13-9-2011
 
2.   Death of Shri Ravinder Balwani in a suspicious hit and run case on 23 April 2012
 
I wish to draw your attention to the resolution of the Commission in its meeting held on 13.9.2011 when it resolved that:
 
"The Central Information Commission expresses regret and takes note of the reported killings of and assault on the RTI users across the country. The Commission underlines the need to take urgent steps by the respective Governments for the safety and protection of the RTI users. The Commission strongly believes that it is the duty and responsibility of the respective Governments to safeguard the life and liberty of the RTI users for which purpose they should invoke the relevant penal provisions for the prevention and detection of such heinous crimes.
2. This Commission, therefore, resolves that if it receives a complaint regarding assault or murder of an information seeker, it will examine the pending RTI applications of the victim and order the concerned Department(s) to publish the requested information suo motu on their website as per the provisons of law.
3. This Commission also resolves that it will take proactive steps in ascertaining the status of investigations/prosecutions of the cases involving information seekers and endeavor to have these processes expedited."
 
The above resolution of the Commission brought some relief and respite to RTI activists who have suffered tremendously in their struggle for transparency, accountability and reduction in corruption and during which more than 15 have lost their lives and innumerable others have been severely injured and beaten up by vested interests.

As has been reported in the media, Shri Ravinder Balwani succumbed to his injuries after being injured in a suspicious "hit and run" incident on 23 April 2012, in New Delhi.

Shri Balwani was a veteran activist who had been using the RTI Act extensively ever since 2001, when the Delhi RTI Act 2001 was introduced. His main area of activity was the privatization of power distribution in the NCR.

His family has already complained, that they suspect a motive to silence him and there have also been reports that his papers had been searched and some are even missing.

I therefore request the Hon'ble Commission, through your good self, to put the words of the above mentioned resolution into practice and take suitable action, specially as per points Nr. 2 and 3 of the above resolution viz:
 
1.   Examine pending RTI applications of Shri Balwani and order the concerned departments to put up the information sought by him on their websites
 
2.   Take proactive steps in ascertaining the status of investigation/prosecution in this case
 
Such action will show the RTI activists in particular and the country at large, that the Commission is serious about its intentions in protecting activists as well as in implementing the above mentioned resolution.

In the interests of transparency, I also urge you to regularly update the CIC website, regarding the action that the Commission takes and keep the activists informed of the progress in this case.

Sir, this is a test case for the Commission, since the death took place in the same city where the Commission is located and the same city where a majority of the Commissioners have spent their working life in the Government. The public authorities on which Shri Balwani concentrated are also located in New Delhi and he was personally known to several officers and staff in the Commission.

I, just like other activists and citizens of the country, am eagerly waiting and watching to see how the Commission acts.
