Dear All,
               This case is alarming to be noted.
In Ahmedabad Trucks and all commercial vehicles are banned from 8.00 AM to till 9.00 PM. But many trucks are allowed to be entered in City , Kalupur Chokha Bazar , Kabutar khana, by taking , collecting money from Truck operators during the said timings. Collection may be Thousands of Rupees in a day!!!!! But if you enter other way by mistake in other area ,SG Highway , you would be prosecuted !!! For this post premiums are called for for Traffic inspectors and all etc. Who cares?
             This also reminds me my own case of towing my vehicle illegally from Shivranjani Cross Road, near State Bank of India Saath Sangath Flats .( Now after Fly over no body cares, no towing of vehicle, where law of no parking area when my Vehicle was towed a way,!!! I had to pay towing charges, But , if you go to the motor vehicle act , there is no provision of towing vehicles !!! But while giving receipt no mention of the place from where the vehicle was towed a way. !!! I filed a Public Interest Litigation in this respect. Justice Mr, B J Shetna took the matter on the first day. Commissioner of Police ( Traffic ) was asked to remain present in court in Noon. When the matter was taken up Justice Mr. B J Shethna asked DCP Traffic Mr. Vikas Sahay a plain question , : Do you know under which Law you are towing the vehicle?" . The reply given by Mr Sahay was , simple, He do not know!!!!!
                                         The DCP was asked to file affidavit in this Petition. But surprising to note the other day , date , Hon. Chief Justice was there . No affidavit was on record !!!   Hon. Chief Justice dismissed the matter without any Affidavit !!!! I am going to file Special leave Petition Before Hon. Supreme Court of India shortly.

Copy of this e mail is sent to Chief Minister Narendar Mody for hie attention. I do not know I will get any comment or not.

Dear  friends
Please  find  attached  a news  published in Sambad which has highlighted  the  issue as to  how  the PIOs  taking the plea of  File Missing    avoid      to provide  the information to the applicants.  In course of  the hearings   many PIOs pleaded   that  as the file concerned is missing,  the information sought by the applicant couldn't  be traced out despite  their hard efforts and so the information couldn't be supplied.  In course of the said  hearings,  the Odisha Information Commissioners do argue in their support quoting the RTI Act  that  the information which is held by the Public Authorities  can be disclosed, and. if the information were  not  available at all, the question of PIO  supplying  the information doesn't arise. Then immediately, the Information Commissioners ask the concerned PIO  to file  an affidavit  saying that  the information was missing. Such an apologetic stance of the Commission gives a golden opportunity to the PIO  to  file the affidavit  and send a copy to the Commission with intimation in some cases to the applicant concerned. By showing such Commission dictated  plea, many PIOs  have started  filing  the affidavit that the information is not available. On account of this newly devised ploy, a large number of  applicants are getting deprived of the information they have sought by spending money, time and energy.  The PIOs are quite aware  that  the poor applicants can not  challenge their affidavits  at the Commission's level or in the higher courts.   Thus, the corrupt bureaucracy and the Commission are hands in glove to protect a degenerate  system by keeping the information secret with the help of their new tactic.
Attached news is a  bright example of it.
