Re: [IAC#RG] First Appellate Authority (RTI) of Congress Party.

Dear Sanjeev

At the present time the 6 political parties named in the (atrocious)
CIC order are theoretically under the RTI Act, but have not complied
with the order.

AFAIK nobody has taken the parties to court as yet.

The CIC doesn't have any further power to deal with them under "complaint" mode.
The CIC's complaint powers are "discretionary" and were wrongly exercised.

The CIC's appeal powers (which are statutory) will be tested when appeal cases
begin reaching them.

Are they bound to deal with emails ? Well the example of NAC's First
Appeal reply to me clearly shows that public authorities are as aware
of the finer points of RTI as some citizens are.

Finally, it is entirely up to the President of Congress Party to
choose to reply to me or not. The information I have asked for is
trivial for any PIO to reply to in terms of RTI Act

The PENALTY for not providing the information for this RTI is not
limited to Rs. 25,000/=.

Finally : here is most likely scenario.

a) NCPRI stooges ('deemaks' / termites) file similar complaints to
Subhash Chandra Agrawal's against state level political parties (eq.
the BJD in Orissa). They quickly get an identical order out of their
SIC. And the state party (like BJD or RJD or some unknown party) will
file a Writ in some High Court - OTHER THAN DELHI HIGH COURT and
obtain a stay. All parties will be very happy.

b) Reason they can't approach Delhi High Court is para 58 onwards of
CIC order of 3.June 2013.
