Re: [IAC#RG] OVERSTRESSED LITIGANT COLLAPSES IN THE BOMBAY HIGH COURT.

As I said there is no short cut method to reach at final destination , that is why various people are trying through small groups and organisations by taking up some important issues, Judicial reforms, police reforms , Judicial appointment commissions  are such important and positive steps. But existing system and its supporters will not allow any kind of change .
Judiciaries  are applauded being positive in several issues . 2G case, Black money Hazan Ali case , judgement against criminals etc. but they are in fact try to cut down the anger of the public  and always garbing faith.  Indian Judiciary is in fact one of the institution where large number of incompetent and useless fellows are accommodated.  " One Retired CJ of HC  told that Earlier when he was the CJ of one high Court  somebody made recommendation abt a lawyer for elevation , after verification he has found that that person is not even fit for an attender's Job . After so many years that CJ was astonished to see that , that very same fellow whom he was not able to find a minimum common sense , was elevated as a Judge of the Highest court of the land...  Indian Judiciary is trying to show themselves as better institution than other , This institution is uncontrolled , No body has courage to touch them ,,, It is worst than our political set up..............

If the power is controlled it is bound to be misused that is what happening in our country ...
The lawyers, police and judges are in fact engaged in non productive activity than offering any kind of useful service to the society .90% of the court functions are mere wastage ..

Wow, never heard a lawyer speak sense like this! Thanks to Indiaresists for bringing us together. Your attention is invited to my blogs at http://raviforjustice.blogspot.com

Not that I have any simple solutions. I share your disillusionment. But part from blogging I do also join small groups protesting for human and civic rights. I have three false cases foisted against me by the servile police who go overboard to prove their allegiance to the thugs, scoundrels and traitors in offices of authority.

solutions are available but no body wants to realize it... I have told so many times that no short cut method or symptomatic treatment  will going to give any relief . RTI , Lokpal are all pain killer method it wont help ,, because our system is bad, our country is facing a terminal disease. u can't solve this disease by administering some injunction ,,, Whatever kind of method we trying are all just like pain killer type of solutions .. It is better to leave it die rather than administering any kind of temporary medicines.

And the problem with our system is bad governance ,, The govt is a creation of the general public and not otherwise , so it is a servant of the public ,, main duty of the servant is to protect its citizens, so the first order function is law and order and defense ,, once the govt completed this first order function then only they can think about second order functions that is building infrastructures.. running business, and services are not govt functions it can be done by pvt ,, in regulated manner , so govt has to leave this all to the public by focusing upon policing, court and defense , plus infrastructure,, by this govt has to reduce its size ,, not a single non productivity activity should be rewarded by freebies .    Govt itself is a service sector .. Just like a best doctor gives better health to farmer and thus it help more production , the govt service sector has to give an assurance to farmer that if he is working hard his earning will not be take away by any criminals ,, that will give more incentives to production , and production will increase ,, increase in production only will result into price cut and not by subsidy .. no govt is supposed to extort money from the people and distribute it for charity ,, tax is for better functioning of government and not distribution .. charity will be done by pvt individuals no govt is supposed to do any charity ,, no reservation no VIP protection all should be equal and treated equally by the govt. .. speedy disposal of cases and impartial investigation is made as dream in this country as this system will help the non productive class to gain all the benefit of the productive class .. If any body wants to see any change then they should understand the importance of good governance ,, that is all
so try for changing the entire system ,,,

This is the visible decease in our country ,, but no body wants to discus at length. if u tried to find out reasoning for such delay u will reach to conclusion that our governing system is based upon some outdated principles which  without any basis and support of logic or reasoning ,, unless and until u  fight for change in the existing system nothing will work ,, I hope various sectors are slowly recognizing this fact .....

OVERSTRESSED LITIGANT COLLAPSES IN THE BOMBAY HIGH COURT.

MY 16 YRS OLD PIL HEARD FIRST TIME: TERMED IRRELEVANT NOW AND DISPOSED OF.

It was Friday 3-30 P.M. 27th Sept. 2013.

Bench : Justice Dhananjay Chandrachud and Justice M.S.Sonak.

I was waiting for my matter to reach for hearing and a big thud was heard from the chair just behind me. The full court room rose on its feet and looked behind. Judges got up and came down.

What happended?

A man collapsed with his chair upside down. Judges left for a while to their chambers. People around turned to help. Doctor was summoned from High Court clinic. Registrar General was standing tense. Patient was in coma. It took 20 minutes for the doctor to bring him back to the senses. Judges came to soothe him. He was crying with folded hands before the judges in prayer posture who couldn't assure him when his matter would be heard. They appeared helpless. Judges went out for few minutes and resumed work again. Meanwhile I asked the unfortunate litigant: 'Since How many years are you fighting you case?' 'six years' replied the man still crying while being taken out.

Immediately thereafter my PIL No. 902 of 1998 reached and I started argument. I was interrupted by the bench stating that my PIL on the irregularities and corruption in junior college admissions was based on 1997 GR (Government Resolution) and subsequently several judgements of the Supreme Court were pronounced on the subject, hence my PIL couldn't be entertained.

I was appearing in person and said that I could argue the matter in lieu of those judgements and justify every contents and prayers in the petition and prepared to take the utmost risk even at the cost of its dismissal. I said I was not at fault in delay of 16 long years! But the judges prevailed on their stand and 'allowed' me to file another PIL! I argued in vain that it involved lot of reworking and receiving info. through RTI and waiting for days and days for the information to be received. Judges said, they couldn't help. I further submitted that during last 16 years I would have urged hundred times to all Chief Justices to hear this PIL but in vain.

My heart cried from within for not geting justice to the poor and merited students but judiciary as usual stood insensitive.

If this is the fate of the Public Interest Litigations what about private and government litigations pending since 20-30 years in almost all courts across the country?
