[IAC#RG] Let Sense of Justice prevail, if He replies!

I found the following letter addressed to Justice Katju by Mr. Sumeet Mehta on Facebook. By reproducing the same here, I though, t it may provide platform to maturely understand some secular issues, Government and Media. It states thus:

I sent this email to Justice Markandey Katju and putting it in public domain for knowledge of everyone:

Respected Justice Katju:

I would like to understand from you whether Hindus are safe in India given the fact that as per Islamic laws and shariya India is Dar – Ul – Kufr and Dar – Ul – Harb. This I understand demands muslims to start a jehad and eliminate Kufrs (as Owaisi called for to kill kufrs in kufrastan).

We have seen this happen successfully in very recent past in kashmir valley where once fatwa was issued, innumerable kashmiri pandits had to hear "raaliv, gaaliv, chaaliv" and while the history of plight, exodus, and genocide of hindus is not widely reported and followed by "secular" media till date, Rahul Pandita's book and also various personal interactions of thousands of hindus with ill-fated pandits has made everyone aware of jehad and islamisation of India. The valley was cleaned of kufrs by muslims.

In this regards, I have few questions:

Are hindus safe in India?
Is Indian government's largesse of Rs 1 lakh crore in this year's union budget and lakhs and lakhs of crores in all previous union budgets, more like a Jiziya to muslims to pacify them by to concede that this is Dar – Ul – Islam and we Indians have accepted their supremacy and hence to practice our own faith we are paying a penalty / licence fee to muslims through government of India?
Is this largesse of lakhs of crores paid to muslims to seek peace so that they don't start killing hindus (which they are anyways doing in all terror attacks – and it would be worth noting that all terror attacks happen in hindu majority localities, and not in muslim localities)?
We have subverted our constitution by allowing muslims to have a separate civil code – which also allows polygamy and oppression of women (which is evident in Shah Bano Case) and we are scared of implementing uniform civil code. Now we are going a step forward in setting up separate fast track courts for muslims (just wondering what crime have hindus done that they have to suffer from slow justice) Is this because we seek to avoid muslims to formally start jehadi activities to make India Dar – Ul – Islam?
Muslim religious institutions get financial support from government, which means that tax payers money is given to muslim religious institutions. Along with that they also get full autonomy and government cant interfere and oversee the affairs of muslim religious institutions who are funded by tax payers. Also it is visible that benefits accrue only to a select section of Indian society and not everyone is benefited by this largesse out of tax payers money. Again this is in contrast to general rules – wherein if government is funding an institution, then everyone must be benefited from that. Also second contrast is that Indian government is selectively giving these benefits only to muslim and Christian institutions, while other minorities like sikh, jain, and Buddhist institutions don't get any such benefits, leave alone hindus. Why this discrimination? Only to ensure that we don't have to fight official and formal jehad, and hence succumb to appease muslims?
Beyond all these general largesse, we also get to know about ad hoc largesse in form of waiver of outstanding electricity bills (ref: jama masjid, delhi whose outstanding electricity dues are waived off by Sheila Dixit Govt). if in case any BJP govt make any allocations for temples, they are accused as "communal" and congress govt doing it for mosques is "secular". I would like to understand what is communal and what is secular?
When gruesome events like genocide of pandits in Kashmir valley, or shahi imam of jama masjid calling for muslims to stand up against Indian state and hindus or do any illegal activities to harm hindus, or very recently desecrating martyrs memorial in Azad Maidan, Mumbai, and Buddha and Mahavira statues in Lucknow, no muslims are arrested and tried. In case of Azad Maidan issue, muslims were "requested" to surrender after Ramzan, so that they can pray in Ramzan. The government was forced to do that only after huge outcry and anger of non-muslims. Why such discrimination? All in name of secularism or to just plead and beg for muslims to not start a jehad or issue a fatwa that India is Dar – Ul – Kufr and Dar – Ul – Harb?
Muslims have strongly opposed all hindu signs and representations - like singing Vande Mataram, or paying respect to Bharat Mata, or doing surya namaskar, as they claim it is unislamic and hence subverts basic norms of "secularism" but they have always asserted their islamic supremacy with their religious symbols getting primacy or even some extra constitutional benefits like Hajj subsidies. Is this a latent or disguised jehad to make india Dar - Ul - Islam? 
To end, I would like to know your opinion on whether hindus are safe in India, or they need to convert to islam or become "seculars" furthering the cause of muslims (like what Raja Maan Singh of Jaipur did) or migrate?

In Karnataka The Information commission has In several Cases ruled that Information should be Supplied by RPAD only . It arose in a case where the police pasted the replies on to the Door of the Citizen(as if a notice /summons)
Even if you Get the them to give their bank account , you will face difficulties as the PIO mat fain ignorance of your Crediting that Amount . Already one such case where the further fees amounting Rs 8000/- credited to Treasury(bank) is Pending before our Information commission after Interim order to Refund , we are claiming Interest for the Lapsed Period .
Therefore the Correct methodology would be that the Replies or Information be sent by RPAD on payment of Further fees .Yes of   course the Postal charges to be Borne by the PA  as decided in Indian railways matter

However, I have sent the IPO's by post requesting to send the info by post, let me see the outcome. I wonder how the information contained in 12 pages cannot be sent by speed or registered post while the PIO will have not to pay for this from his own pocket but from the DTC.  Do not know whether he is acting on the instruction of the higher authorities or on his own.

Industries may be located in various states but corporate offices are mostly located in Mumbai (Maharashtra) or Delhi. Any financial transactions like FDI must necessarily be at the corporate levels. For instance Reliance factories are in Gujarat and corporate office is in Mumbai. Hence the difference you have pointed.

Facts will only be known once FDI related to various industries or corporations are revealed.

A Mr. Anil Gidwani came back from USA to India (Mumbai) in 1998 and stepped into the shoes of his grandfather who had started litigation in 1961 to remove a tenant (a lady lawyer) .How Mr. Gidwani taught himself law to successfully argue against the present Attorney General's Petition is quite instructive and illuminates the legal acumen, if any, of India's top law officer (a Mr. Goolam E Vahanvati) in filing vexatious litigation.

Humanity fails to understand that Judiciary has nothing to do with justice. 'Justice' is the first casualty in judiciary. By default Judiciary has to uphold the Indian Constitution and Law. [THIRD SCHEDULE OF THE Indian Constitution, Form IV and VIII read with Article 29(1) of the Indian Constitution]. How can Judiciary deviate from her own oath? Judiciary is house of organized financial racketeers, pettifoggers, frauds, usurpers and cheats. A man of character cannot stay in judiciary. Kania CJ and 4 other JJs. Date decided 5-10-1951) pertaining to the fundamental right to property, again when her subordinate Calcutta High Court held (Chandmal Chopra v State of West Bengal AIR 1985 CALCUTTA 104; 1986 Cr.L.J. 182) that no court can sit into the judgment against the guides of criminals named Koran and Bible, when apex court awarded salaries to Imaams (AIR 1993 SUPREME COURT 2086) and when apex court legitimated Hajj subsidy. Writ Petition (civil) No.1 OF 2007 in the case of Prafull Goradia VERSUS Union of India.

While he was heavily criticized for this personal indulgence from all quarters, the flamboyant VC had shrugged off the criticism saying that 90% of VC residences in India have swimming pools. He told local the press to publish whatever they deem fit as it wouldn't matter to him. 
    However, the unapologetic arrogance did not go down well with the state government, which is reported to have given a Pal firing for having the pool constructed without necessary permissions. He was also given an ear
ful for such indulgence in times of a water crisis in the state. 
    "The work on the swimming pool has been ordered to be halted with immediate effect. The VC has also been asked to submit an explanation", said education minister Bhupendrasinh Chudasama. National Students Union of India (NSUI) leaders again protested the construction of the pool on Saturday, especially when the students in GU hostel do not get water to bathe. They had also protested on Friday. On Saturday, Akhil Bharatiya Vidyarthi Parishad (ABVP) too joined the protest against the move by the VC. 
    Meanwhile, the protest was not taken lightly by security personnel at the GU VC residence, who hurled bricks and stones at the media men gathered to cover the protest. Later, the VC gave interviews to TV pressmen and said, "Nearly 90% of VCs all over the country have swimming pools in their residences. I am not doing anything extraordinary. Also, since the pool is being constructed in the VC official residence, the bill has to be footed by the university." 
    The buildings committee of GU recently passed the pool's construction at the cost of Rs 20 lakh. The pool, measuring 35 feet in length and 15 feet in breadth, was to be for the VC's use, despite the fact that there isn't even a students pool in GU.

So only for a ring I would be liable for import duty on Rs. 3000. There is no provision to document that those jewellery pieces would be taken back by the visitor. They also told him he could  check new rules by India's Income tax dept. Any one staying there over sixty days would beep required to pay income tax in India for the all income around the world.
Can anybody throw more light on this aspect.

The Police case should be registered in South Delhi. The Civil cases can be instituted in Karkadooma Court (East Delhi). Your cause of action for East Delhi is not strong as for South Delhi where the 498A took place.

Look at it from the investigative agencies point of view. How will East Delhi Police properly investigate something which took place in South Delhi.

On this basis, she gave a complaint (u/s 406, 498A)  to Delhi Police CAW Cell in East Delhi, but the boy and his family managed to convince / persuade police of East Delhi that she (the Girl) is not resident of East Delhi (by whatever wrong means) and got the case/complaint transferred to South Delhi (where the Boy's family is residing), only to benefit the boy and his family as they are living and also running their Hotel business in South Delhi.

In the meantime time Girl has got affidavit from court  and also got Election Commission's Voter ID Card to prove her residence in East Delhi and they are placed on record in the complaint file.

Now I want to know that:-

1.       Wheather the case  of 406/ 498A in this situation be registered at the girl's present  place of residence in East Delhi merely on ground of her staying here and not in Ghaziabad /or South Delhi?

2.       East Delhi Police says there is no cause of action in East Delhi, We say that the girl asked for refund of  her Istri- Dhan (Gifts given to girl at the time of marriage) while staying in East Delhi and her in-laws refused her request. We say that this is cause of action for police to register the case in East Delhi. But police is not accepting this.
 
Kindly provide any sections  of IPC /CrPC or any High Court/ Supreme Court orders / directions in this regard which can be helpful to the girl & her family and put before Delhi Police senior officers at PHQ for getting the case registered in East Delhi Police/Courts jurisdiction.

Are you not aware that most of the businesses/ industries started and running in Gujarat like Reliance or Ruia-s ..etc. have their Corporate Offices in Mumbai and the FDI flowing to them is taken as if in Maharashtra?
 
Unless FDI flows are tabulated Companywise, these figures of funds flowing into States would be misleading as the Corporate office has  few employees running the show but the investment and industries employing thousands are situated elsewhere.

Check with the haunted: ghosts do not die. Since this sounds like the ultimate paradox, some explanation is necessary. Ghosts are not happy spirits. A ghost is spectre of justice denied, a moan from beyond the grave, revenge that has survived burial. A ghost does not leave judgement to God; it seeks its target while the assailant is still alive.

Many of those who instigated mobs in the anti-Sikhs riots of 1984 are dead; some have slipped, with age, into decrepitude. Legal justice has been tawdry, because the establishment has protected the guilty. But there are at least two VIPs who cannot shake off their ghosts despite 29 years of protection and promotion, offered by Congress, which has been in power for 21 of these years. Sajjan Kumar was an MP and would have remained one till now but for an accidental burst of anger by a Sikh journalist in 2009. Jagdish Tytler is a senior Congress leader, with a seat in its highest committee.

The ghost chasing Tytler is relentless. Each time Tytler becomes complacent, it pops up. Tytler has reason to be complacent. It took India's premier police unit, CBI 23 long years to produce its final report for the courts; it concluded that there was no case against Tytler. The court was sceptical. Two years later, in 2009, CBI repeated its charade, despite the fact that the Nanavati Commission had held Tytler culpable. India, thankfully, is not a police state. A sessions court has again thrown Tytler back into the public limelight.

Tytler behaves likes a split personality when he appears on television to defend himself, half anxious, half smug. His central argument is equivocal: he does not challenge the Nanavati verdict, but adds with a shrug that it is hardly his fault if CBI did not find any evidence. The smirk is almost too much to bear. What Tytler, his guardians and acolytes do not quite understand is how much India has changed. There are many reasons obviously, but it can be said that one of the catalysts was the Gujarat riots. A cover-up is no longer possible. In 1984, Rajiv Gandhi read out a speech written by an over-smart bureaucrat justifying the violence with the metaphor that when the earth shakes, a banyan or two is bound to tremble. No one would suggest this today. The Gujarat riots have been followed by unprecedented media investigation, and judicial scrutiny supervised by the Supreme Court. VIP politicians are in jail. The process is exhausting and exhaustive, but it will separate the guilty from those who were not directly responsible.

No politician ever went to jail for riots before Gujarat; in fact, hardly anyone went to jail at all. Take a count of major incidents in the last five decades: Jamshedpur in 1964, Ranchi in 1967; Ahmedabad in 1969, when some 2,000 died; Nellie in Assam in 1983, where 5,000 Muslims were estimated to have been killed [I shall never forget the rows of dead babies I saw when I went to report that story]. Hiteshwar Saikia of Congress was Chief Minister of Assam then, and Mrs Indira Gandhi Prime Minister. No one demanded his resignation. Instead, Saikia was often lauded as an astute political craftsman. In 1989 came Bhagalpur, when over a thousand died. Let alone Congress CM Bhagwat Jha Azad being held responsible, even the police chief was not shifted. Sudhakar Rao Naik was CM of Maharashtra during the three months of riots in Mumbai following Babri in 1992-93; the guilty named in the Srikrishna report have been left free. Narasimha Rao was PM then. It is a depressing list.

Public accountability, spurred by popular will, is principally responsible for the reduction in the scale and frequency of riots. Politicians may be worried about courts, but they are terrified by voters. The mood of the country has changed visibly. The young, who are in the forefront of this change, want to leave the past behind; for them governance is measured in economic growth and jobs. It is self-evident that violence and development cannot co-exist. Investment in Gujarat will shrink if there is another riot. The young want to vote for jobs, not for the problems of 1947.

If you want to predict election results, an astrologer may still be of some use; but it is far more useful to look at unemployment figures, followed closely by an examination of corruption levels. Voters resent corruption because it is theft; what makes them apoplectic is that it is theft of their money, or the nation's resources. A nation belongs to the voter, not to a government. Governments are only temporary custodians.

There is no truth about politics, which is totally true. But that which is largely true determines the fate of elections. Caste and creed have not disappeared, but pillars of the old life are fading as another new age begins to rise on the Indian landscape. And when they are finally buried, they will not beget any ghosts.
