In a media interview , that was published on  21st March,2015, Chief Election Commissioner Mr. H.S.Brahma  has said that law  is not a panacea for poll ills.  Confessing that money power plays role in elections  and business and money are involved in the  election process, he  has  said  that law is not going to solve any problem and people should be told that in their own interest , they must vote for the right person.

Obviously, by the above confession, Chief Election Commissioner  expresses his inability to ensure fair poll, which  make  one wonder  as to what is the Chief Election Commissioner for ?

The problem today is not due to lack of laws but inability and unwillingness of Election Commission to enforce the law in letter and spirit. Election Commission rarely punishes the politicians who violate the model code of conduct and often ends up in issuing warnings which no politician seems to take seriously. Election Commission today is viewed as a barking dog that seldom bite.
Even when Election Commission seizes the money that may be meant for bribing during the polls, it does not follow up the matter and punish the concerned political party but simply leave the matter to the Income tax authorities. What has the Election Commission done about  the allegation that AAP received Rs. 2 crores , during the recent Delhi polls from fictitious source. Election Commission's deafening silence in the matter indicates it's attitude to it's responsibility.

Bribing of voters has become the order of the day in several states including Tamil Nadu. Several such instances have been brought to the notice of Election Commission during the elections  but  it  has often ignored them  fearing the politicians. This is so, since Election Commissioners owe their positions to the politicians.

To cut the long story short, one instance is enough  to show the weak approach of the Election Commission. A  notorious by election in Tamil took place in Tirumangalam a few years back, when money was distributed openly to the voters. The then Chief Election Commissioner himself admitted this disgusting scenario but he did not move ahead to countermand the poll. Obviously, he lacked the courage of conviction , inspite of the fact that the Election Commission is a constitutional body  with great responsibility.

 Now, in Tamil Nadu politicians use the term "Tirumangalam formula" ,as  one sure method for winning election.

The statement of Chief Election Commissioner that law is inadequate and he is helpless deserves strong criticism and condemnation. Obviously, we need Election Commissioners with greater sense of determination and commitment to the national cause of conducting free and fair elections at any cost.

The kid arrogance of top AAP decision makers and its spill over in media  in cutting down the united AAP is evident.

Crisis in AAP is institutional in nature, solution has to be institutional  in character. AAP may soon be losing the war of perceptions, eventually impacting its electoral appeal.

1. Volunteer's body  must have a representational  presence in decision making bodies of AAP.

Normally Supreme court will refer a case to larger bench if there arises any conflicting decisions from a co-ordinate Bench. Otherwise their is no need to refer any case as a Division bench is competent enough to declare the law within the available limits . So it  is totally illegal  to refer Teestas Case to larger bench . The small judgment is starting with longest ever sentence in the English language. Here the question is Whether this countries public is still living in middle age? What are the steps taken by our administration to improve this system to prove it is not working in colonial era ?

Court pendency behind India's low global ranking: World Bank.


NEW DELHI: Large pendency of cases in Indian courts and non-implementation of judicial reforms have been cited by the World Bank as one of the key reasons for India's low rank on the Bank's Index of 'Ease of Doing Business'. India was ranked 142 among 189 countries last year.


In a memorandum to the department of industrial policy and promotion (DIPP) under the commerce ministry, the World Bank suggested linking judges' appraisal with reduction of pendency in courts. Sources said the matter was discussed at a meeting organized by the DIPP recently to refine the performance evaluation system of judges to link their performance to the resolution of specific bottlenecks as suggested by the World Bank.


The DIPP is also coordinating implementation of the 'Make in India' campaign of the Modi government.


Interestingly, the World Bank suggested that there was an urgent need for reforms in the system of performance appraisal of judicial officers in the country to bring about uniformity and infuse objectivity and standardization.


The Bank cited an example from Malaysia where implementation of a reform index for judges improved case disposal rates and reduced backlog by 50% in less than three years. Another example was cited from the United Arab Emirates, where rewards were instituted for the best performers.


According to the memorandum, the liberal grant of adjournments was an often cited reason for delays in court proceedings in India. It recommended monitoring the number of times judges granted adjournments and the reasons for granting them. "This can be done through case management systems and linked to performance management evaluations," it said.


It asked the government to ensure that adjournments were not indefinite by setting a time limit.


Just a few weeks ago, the Modi government had written to chief justices of all 24 high courts to ensure speedier settlement of commercial and other disputes for creating a conducive investment climate and success of 'Make in India' campaign.


"One of the reforms introduced by Malaysia between 2009 and 2011 during the overhaul of the judicial system was the implementation of a reform index for judges," the Bank said, citing how this index, fixed by the judges themselves, was aimed at allowing them to assess and monitor their performance. As a result of this and other measures, case disposal rates in Malaysian courts improved and backlog was reduced by 50% in less than three years, it said.

Railways should change the Rules to the effect  that for the first 30 Minutes , Tatkal Reservation could be made only from the City/Town/village etc from where it is proposed to travel or to which place it is proposed to travel.Genuine railway users  who are put to the necessity of making an urgent trip will really be the beneficiaries .For this purpose,'Tatkal local timing' can be 9.30 am to 10.00 am. Thereafter Tatkal tickets can be sold from any counter ,from any place and even by travel agents and by users through e-mail.There is no meaning in saying ''down with corruption''. We should suggest ways and means to avoid the same or at least to minimise the same and to facilitate intended benefeciaries to achieve the goal .

On 16.3.2015 I perused the website of the Commission in connection with the above noted case reference and found that the Commission observed that I did not send any comments on the report of BSF and Police by 6.5.2013.


In this connection I would like to mention that I received the Commission's letter dated 5.4.2013 along with the copy of the report from Police and BSF authority. Upon receipt of the same I sent my comments on the police and BSF report to the Commission through my email on 23.4.2013. One copy of the said email dated 23.4.2013 containing my comments on the police and BSF report is attached herewith for your kind perusal. 


I hope that the Commission would note the above in the record in connection with the above noted case reference and take appropriate action in this regard.

Our comments against the reports of BSF and Police

 

Respected Sir,

First of all I want to apologies for my previous reply sent to you yesterday by email. Please ignore that. Here is my reply.

We received your letter dated 5.4.2013 in connection with NHRC Case no. 1491/25/15/2012-PF along with the documents attached with your letter. We place our comments on the reports herein below:-

It is stated in the report of the Sub-Divisional Police Officer, Basirhat, North 24 Parganas that during enquiry Ms. Aleya Bibi stated that Jafar Gazi, son of Siraj Gazi of Nabatkati, distant relatives of the petitioner has taken Rs. 1000/- from her on the plea that he had to pay it to the Custom Officer. But surprisingly the enquiring officer did not examine Jafar Gazi for the reasons best known to him. The victim Jubbar Molla and his mother Aleya Bibi were examined by the enquiring officer and they affirmed the incident of torture and apprehension of the victim by the perpetrator BSF personnel before the enquiring officer.

 

It is also stated in the enquiry report of the Sub-Divisional Police Officer, Basirhat that "…Officer of Khalsi BOP and Kaijuri of 152 Bn BSF were also examined and relevant documents were examined but nothing could be found to corroborate that Jubbar was either apprehended or detained by the BSF authority…" In this juncture we would like to mention that in Paragraph 4 of the BSF report it is stated that Zubbar Molla (age approx. 10 years) was apprehended on 1st July, 2012 and he was brought at BOP Khalsi for preliminary questioning. Then he was sent to Saraful Rural Hospital for medical examination and he was handed over to custom authority Tentulia. Such report of BSF itself evident the cruel and inhuman treatment committed upon the victim Jubbar Molla who is a minor. The victim being a minor was subjected to questioning as evident from the report.  The report is itself proof that the victim's parents were not informed about his apprehension by the BSF personnel and he was clandestinely handed over to customs officials.

 

On the other hand the Superintendent of Customs, Tentulia Customs Preventive Unit in his letter (Memo no.- C no. VIII(26)tent/Cus/Con/2006/376) dated 8.10.2012 addressed to the Officer-in-Charge of Swarupnagar Police Station affirmed that no such case booked from 25th July, 2012 to 1st August, 2012 in the matter of the victim boy Jubbar Molla, son of Rabiul Molla of Nabatkati, Police Station-Swarupnagar, North 24 Parganas.  

The Additional Superintendent of Police, Barasat, North 24 Parganas vide his letter(Memo no. 352/NZ) dated 11.2.2013 addressed to the Superintendent of Police, North 24 Parganas  stated that during enquiry it has been transpired that BSF personnel had allegedly detained Jubbar Molla on 27th July, 2012 while he was grazing cattle and he was subsequently released. 

 

Therefore, in short, the reports of the authorities are contradictory with each other and there is no attempt to come with clean hands with their so called reports before the Commission. It seems that the police and BSF authorities are only concerned to save their skin. There is no doubt to assume that the reports are manufactured and concocted.

 

Hence we request the Commission to set aside the reports placed before the Commission by BSF and the police authorities and direct a neutral investigation by the Commission's own investigation wing by considering the comments placed by us.

Modi Govt. has seriously erred on this issue ignoring the following factors-

1. Very liittle time was allowed to assess the results of the land reform bill 2013 of UPA Govt. which was passed after protracted negotiations. Through this Sonia Gandhi tried to portray herself a s Champion of farmers interest.
2. Undue haste was shown in bringing the Ordinance so much so that even the President had to question what was the haste in bringing the Ordinance.
3. Failed to anticipate the emotive response of the masses and its exploitation by the opposition.
4. The Prime Minister is carrying a baggage of pro-industry and anti-farmer animus from his Gujrat governance of over a decade.
 5. Not doing enough spade work to justify  aquisition for private players.

Although the Govt. has gone on record to say that they are only  restarting to complete the stalled project in infrastrcture of UPA Govt. they should have given the details of such projects and the land required for those projects, money already invested in those projects by UPA Govt. and the NPAs of the Banks.
Surprisingly UPA has gotten away with huge land acquisition Projects for SEZ projects for Private players through out the Country and its architect the former Miniter Kamal Nath. Suffice to remind of two projects of Relianace in Haryana and Maharastra each involving more than 5000 acres of Agril land.
Land for roads and houses for the rural poor should have been left for the Punchayats to implement.
Likewise land for defence projects in rural areas is also a very weak ground. As it is Land already with the defence is not properly utilised, is heavily encroached upon and misutilised for entertainment like Golf clubs. Otherwise scams like Adarsh in Mumbai and North east would have not occured.It will not be out of place to me ntion that Raghuraman before he became the Governor of RBI had termed the land scam as the biggest scam in India.
The Govt. should gracefully retract on this bill and get state Govts. more actively involved in its support.

well said, sir.a reverse process is required now. A NEW LAND ACQUISITION BILL-taking unutilised and not at all required industrial land and utilising it for establishing government agricultural farms.

There are thousands of acres of industrial land presently occupied by many industries,  where only a portion of the land is utilized and other land remains unused. There are many sick projects which has been remaining closed with hundreds of acres of land that are not presently put to any use.   There are many  educational institutions with hundreds of acres of land , where only a few acres are utilized. There are also land where the  site is not suitable for agricultural operations. The government  is not known to have enumerated  such unutilized land available in the country. The government cannot say today that the country does not have such unutilized and wasted land.
Amongst the existing industries and in special economic zones , the government should conduct a land auditing to identify the unused land and force the industries  to give up such land for setting up new projects. This is possible.
The genuine question is why agricultural land should be taken away without putting the unutilized and  wasted land  for use for setting up industrial projects.
Should the interest of agriculture be sacrificed for the sake of industrial growth is a very valid question. People cannot live without food but they can live without cosmetics and automobiles.
Industrial growth should be complimentary to the agricultural growth and it cannot be allowed to become a substitute for agricultural growth even to a limited extent. Such move is bad in principle and contrary to the sentiments of large section of the country men.
Above all, the potentials for exploiting agricultural operations for India's economic growth with equanimity is no less than what industrial operations can achieve for the country.
Modi government appears to have erred in moving land acquisition bill.
