[IAC#RG] A Nobel prize winner explains why "AAP is an A-team and B-team party".

For experts only:-

India Against Corruption has consistently stated from the time of
formation of the Aam Aadmi Party in Oct 2012 that AAP is an A-team of
Congress and B-team of BJP.

However, to understand this curious situation we need to understand
Nobel Prize winner (Economics:1972) Kenneth Arrow's "impossibility
theorem".

Kenneth Arrow investigated the general problem of finding a rule for
constructing social preferences from individual preferences. As an
introduction to the problem suppose we wanted to find the social
preference for the three ice cream flavors, vanilla (A), chocolate (B)
and strawberry (C). One possible method for determining the social
preference is by majority voting on choices between each pair of
flavors.

• 45 votes A > B > C (45 people prefer A over B and prefer B over C)
• 40 votes B > C > A (40 people prefer B over C and prefer C over A)
• 30 votes C > A > B (30 people prefer C over A and prefer A over B)

Flavor A has the most votes, so it would be the winner. However, if B
was not made, C would be the winner, as more people prefer C over A.
(A would have 45 votes and C would have 70).

This result is a demonstration of Arrow's theorem which states that a
clear order of preferences cannot be determined while adhering to
mandatory principles of fair voting procedures. In other words, there
is no rule, majority voting or otherwise, for establishing social
preferences from arbitrary individual preferences. This theorem
indirectly explains why AAP is now crying over rigged EVMs. (NB: The
fact that EVMs are riggable and actually rigged is another story).

This was a major result and for it and other work Kenneth Arrow
received the Nobel prize in economics.

Is there a way out of this dilema ? Arrow says there is one (and only one)

"Social preferences should depend only upon the preferences of one
individual; i.e., the Dictator".

So the consequence of this is the well known 'Gibbard–Satterthwaite
theorem' which states that if a social choice function whose range
contains at least three alternatives is strategy-proof, then it is
dictatorial.

MORAL : Apparently if Arvind Kejriwal was not CM of Delhi then
Narendra Modi would not be PM of India.

India Against Corruption is not going to report anything of the sort
and pander to their "mai-baap" culture by begging for a few crumbs
thrown from their high table.

Neither shall we be distracted. We have a clear case here where the
senior-most officers of the Transport Department have brazenly
organised systematic and corrupt breaking of the law over a
considerable period to enrich themselves in crores within a short
period of time.

Let this government investigate and explain the reasons why thousands
of offenders were prosecuted and let off by "compounding" offences at
a paltry Rs. 100 when the Delhi Traffic Police prosecutes the
identical offence at Rs. 5,000 as NON-COMPOUNDABLE punishable through
the courts.

This IAS lady, whatever her name is, is in charge of both the people
authorised to prosecute this offence and we shall see how far this
corruption extends to. IAC has just read a large dossier of a third
party involving this IAS lady when she was a Joint-Secretary in
Ministry of Non-Renewable Energy ("MNRE") and it was pretty clear why
she had to leave from there in a tearing hurry.

Thanks, and please add an enquiry about Nehru Place bus stops too. Some Orange bus drivers don't stop at the stop before Eros Hotel light if they see the light has turned green. This is awful for commuters waiting at the stop. Neither green nor Orange buses stop at the bus stop at all if they see groups of school students throbbing the place. So ordinary commuters suffer.

Secondly, conductors don't ascertain whether all passengers including old people, children and women have boarded the bus begore starting again leading to a dangerous scramble on to a moving bus.

You also repeatedly impugned my sanity on a public forum like Twitter for complaining about your department's policies, irregular processes followed by your officers and you adopted innovative evasive methods to obstruct/prevent me from meaningfully responding to your department's public notice issued by Shri K.K.Dahiya (Special Commissioner (Transport)/GNCTD).

Accordingly, on the basis of the said as yet unrefuted news report in DNA newspaper, I am calling upon you to dutifully inquire against and/or prosecute Shri K.K.Dahiya (Special Commissioner (Transport)/GNCTD) as well as each and every member of his 80-member enforcement team from your Transport Department for criminal misconduct and corrupt abuse of their position as public servants to cause wrongful loss to the State exchequer amounting to crores of rupees and corresponding wrongful gain to traffic offenders and to save the traffic offenders from mandatory prosecution by the court as prescribed in law. Fortnight-long drive to start today; errant drivers will be booked, challaned, and may end up losing their licences

The drivers of low-floor Delhi Transport Corporation (DTC) and cluster buses will now be booked for not halting at designated stops. Numerous commuters had complained that instead of the bus shelters, these drivers halted in the middle of the road or a few metres away, making them run to catch the bus. Prompted by these complaints, the Delhi government's Transport Department is all set to start a drive against them on Thursday.

The department has formed an 80-member team of enforcement officials to crack down on bus drivers in the fortnight-long drive. The officials in plain clothes will be deployed at major bus stops, including AIIMS, Safdarjung, Dhaula Kuan, INA, Peeragarhi, ITO, Mukarba Chowk, Lakshmi Nagar, and Akshardham.

The national Capital has over 5,000 bus queue shelters, of which around 2,000 will have the presence of these enforcement officials.

"In the first two days, the errant drivers will only be given a warning. If they continue to indulge in the practice, they will be challaned. In case of repeated challans, a driver may lose his commercial license," Special Commissioner (Transport) K K Dahiya said.

The challans will be issued under Sections 122/177 of the Motor Vehicles Act, 1988.

Not halting the bus at the designated spot leads to chaos and congestion on roads and holding up of traffic, besides posing a challenge to the elderly, women, and specially-abled people, Dahiya said.

The department has also shot letters to the DTC and the Delhi Integrated Multi-modal Transit System (DIMTS), which runs cluster buses, to rein in the drivers violating the norms. Many complaints regarding speeding, rash-driving, and not stopping at zebra crossings have also reached the authorities.

At present, the DTC has a fleet of 5,600 buses, of which only 4,200 are plying. The rest are defunct. According to a recent survey, Delhi needs at least 11,000 buses on a daily basis.

In 2015, the Aam Aadmi Party (AAP) had promised to add 10,000 buses to the DTC fleet and 736 to the cluster fleet. While no new DTC buses were procured, only 215 cluster buses were finally added.

Dear Transport Commissioner,

I am shocked by the abusive and intemperate language you have used in twitter discussions with Er.Veeresh Malik and Er.Sarbajit Ray when they requested you to be informed the basis of some public notice your department has issued and under which legal enactment commenst were invited from them.

On what basis do you describe such genuine crusader persons as "insane", and their comments as a "madfest" merely because they had requested information under Right to Information Act to respond to your public notice.

Is it their fault that GNTCD's new RTI portal is so unreliable and not working for days due to payment gateway issues.

Are you unaware that all public authorities are supposed to disclose all relevant facts to the public before calling for public consultations with such experts.

Also, who are you to "reserve your judgment on their sanity" ?

Finally, you are certainly aware that usage of social media by AIS presently needs prior permission from government and you are expected to be courteous and speedy in your dealing with members of public at all times and only provide information under Right to Information regme and not otherwise.

Because you have deliberately extended responding date and disclosed sensistive official information directly from your Twitter and Facebook accounts to some foreigners who are tranport sector touts wishing to participate in ypur public notice but refused to give information to RTI experts Mr.Veeresh Malik and Mr.Sarbajit Ray to facilitate their similar participation, I have no hesitation in describing your action as serious misconduct contravening your AIS conduct codes and rules and shall advise M/s Malik and Roy to formally complain against you and get you chargesheeted accordingly.

[IAC#RG] COMPLAINT re: non-functional GNCTD RTI web portal

Dear Chief Minister

I refer to certain social media exchanges on Twitter.com between top leadership of INDIA AGAINST CORRUPTION and Ms Varsha Joshi concerning GNCTD's Draft parking policy and inviting public comments thereon.

When INDIA AGAINST CORRUPTION objected to Ms. Varsha Joshi, IAS (Transport Commissioner - Addl. charge) that there was insuffiicent section 4(1)(c) RTI Act proactive disclosure to enable us to respond to the draft policy, we were advised by her to file online RTI on the newly inaugurated portal.

Thereafter the GNCTD RTI portal was non-functional for us the whole day with timeouts from E-SBI gateway so that we could not pay the prescribed fee. Accordingly when we provided our list of relevant facts to be disclosed, in RTI or otherwise, to enable us to respond to the public notice, your IAS officer initially questioned our sanity, then advised us to use paper mode to file our RTI and thereafter blocked us after again questioining our sanity.

Accordingly please find appended below a list of information we are very urgently requesting suo-moto from GNCTD to respond to this public notice.

I would also strongly urge you to instruct your officers to avoid social media and/or not use it to selectively disclose official information (especially to foreigners) outside of RTI Act. I remind you of the DOPT Conduct Rules which are applicable to your officers and which they are expected to follow as emanating from their cadre controlling authority.

Kindly acknowledge receipt of our grievance promptly since we wish to respond to the draft parking policy and its related matters.

 In TV debates, no party spokesman replies to specific issues but when on weak ground only start blaming the other political parties. At least members of IAC need to analyse the issues based on facts and figures and not only make political and un connected statements.

An analysis of number of pilgrims and attacks on them year wise has been published by a National Newspaper and is given below. Average number of pilgrims in year 2000-2003 period was 1.4 lakh per year and number of devotees killed in terrorist attacks was 43. from 2004 to 2013, the average number of pilgrims rose to 4.4 lakh per year and terrorist attack on devotees became nil. The average number of devotees per year has again plummeted to 2.2 lakh in 2016 and only 1.5 lakh this year till now and we have seen one attack by terrorists.

Casualities amongst devotees are matter of concern and the attacks by terrorists needs to be dealt with firmly. However, has this statistics to do some thing with policies of the Central Government? Fall in number of pilgrims and rise in terrorist attacks is coinciding with BJP rule in the centre.

B, Directorate General, BSF, in which it is stated that the departmental inquiry conducted into the complaint, could not substantiate the allegations levelled against BSF personnel. A chargesheet has been filed by the local police with the Court and a prayer for claiming the case has also been filed by BSF with the Court. It will therefore, be pre-mature to award monetary relief to the victim until and unless it is adjudged in the Court of Law, either by Criminal Court or by BSF Court. It is further stated that the Protection of Human Rights Act, 1993, does not give any power to the Commission in respect of Armed Forces to enquire suo-motu or on a petition presented to it into complaint of any violation of human rights U/S 19 of the said Act. The Commission may either not proceed with the complaint or, as a case may be, make its recommendations to the Government. The Commission has perused and considered the reply as well as other papers placed on record. Vide proceedings dated 02.06.2016 the Commission had issued a show cause notice to the Government of India through the Secretary, Ministry of Home Affairs to show cause, within six weeks, as to why monetary relief of Rs.25,000/- should not be recommended to be paid to the victim Bappa Molla for violation of his human rights. It was also observed by the Commission that since the act of public servant has violated the human rights of a minor victim boy, the State is vicariously liable. It is admitted in the reply that a chargesheet has been filed against the BSF person. Under the provisions of Section 19 of Protection of Human Rights Act, 1993, the Commission may make its recommendation to the Government. The perpetrators are the Govt, ie the BJP Govt at the Centre and the
BJP-PDP coalition in the state of J&K. (since Mr. Amit Shah is the
president of the ruling BJP is suppose he is indirectly responsible
for this muckup).

Probably these are cynical political exercises for vote bank
polarisation and to keep Hindus and Muslims apart. In J&K
anti-national political forces kill Hindus in a Muslim majority state
and in UP they kill Muslims in a Hindu majority state. Seemingly these
are the same imperialistic divide-and-rule polices which India
suffered during our first war of Independence (the second one is still
to come).

It was not the Congress which divided the country, it was the British
stooges like RSS and Gandhi who never wanted a strong and united
Hindustan.

NB: if you ask patriotic Hindu forces (like Hindu Mahasabha) it was
the RSS who sneakily collaborated with the British, engineered riots
and converted Hindustan into this moth-eaten abomination called
"India, that is Bharat". Millions of Hindustanis believe the Hindu
Mahasabha martyrs did the most patriotic act possible by assassinating
Gandhi before he could divide the country further.

You must also know that there are imperialist forces which ensure that
India does not have its indigenous weapons manufacturing capability to
the extent that the permanent P-5 powers do. They will ensure that
India and Pakistan are perpetually fighting so that they can sell arms
to both sides.

If Anil Ambani, Ratan Tata and Anand Mahindra are the sort of people
to whom India's weaponry is being entrusted by the gang of four
(Modi-Shah-Doval-Jaitley), only God can save this country (or what
little is left of it). We have never forgotten that Modi sarkar is
purchasing Rafale planes (because some "Ambani" was the middleman) at
4 times the cost the Congress negotiated.

Direction issued by the CommissionThese proceedings shall be read in continuation of the earlier proceedings of the Commission dated 06.09.2016. The Commission had observed and ordered as under : "The DIG (Ops.D), BSF, Directorate General, BSF, has requested for six weeks time beyond 19.08.2016 for submitting a response to the show cause notice. The request is granted. The response to the show cause notice is expected to be received in the Commission within six weeks". Pursuant to the directions of the Commission, a communication dated 22.08.2016 has been received from the Under Secretary, Ministry of Home Affairs (IS Division), Government of India, alongwith a reply dated 19.08.2016 to the show cause notice submitted by the DIG (Ops.) B, Directorate General, BSF, in which it is stated that the departmental inquiry conducted into the complaint, could not substantiate the allegations levelled against BSF personnel. A chargesheet has been filed by the local police with the Court and a prayer for claiming the case has also been filed by BSF with the Court. It will therefore, be pre-mature to award monetary relief to the victim until and unless it is adjudged in the Court of Law, either by Criminal Court or by BSF Court. It is further stated that the Protection of Human Rights Act, 1993, does not give any power to the Commission in respect of Armed Forces to enquire suo-motu or on a petition presented to it into complaint of any violation of human rights U/S 19 of the said Act. The Commission may either not proceed with the complaint or, as a case may be, make its recommendations to the Government. The Commission has perused and considered the reply as well as other papers placed on record. Vide proceedings dated 02.06.2016 the Commission had issued a show cause notice to the Government of India through the Secretary, Ministry of Home Affairs to show cause, within six weeks, as to why monetary relief of Rs.25,000/- should not be recommended to be paid to the victim Bappa Molla for violation of his human rights. It was also observed by the Commission that since the act of public servant has violated the human rights of a minor victim boy, the State is vicariously liable. It is admitted in the reply that a chargesheet has been filed against the BSF person. Under the provisions of Section 19 of Protection of Human Rights Act, 1993, the Commission may make its recommendation to the Government. In the above circumstances, the Commission recommends to the Government of India through its Secretary, Ministry of Home Affairs, to pay Rs.25,000/- to the victim Bappa Molla. With this recommendation, the case is closed.
